The Principle of Legal Protection in the Provision of Emergency Contraception Services for Rape Victims under Law 36 of 2009 on Health

Rape, a violent act involving coerced sexual intercourse, necessitates the provision of emergency contraception services to prevent unwanted pregnancies. Competent and authorized healthcare professionals are responsible for delivering these services, which governed by government regulations in accordance with health law. Thus, author explores legal protection that offer both rape victims providers, highlighting underlying principles this implementation. This research employs descriptive analysis using normative juridical approach. Findings indicate several barriers service provision, including limited doctor knowledge, inadequate standard operating procedures, exclusion from hospital's essential medicine formulary. Emergency legally regulated as part Health Law, they fulfill needs victims, surpassing hierarchy Government Regulations. By preventing pregnancies without need complicated procedures like abortion, significantly enhance workers. However, current lack provisions mandating information providers. Consequently, not all workers willing due absence obligations. To ensure availability legislative changes should be made introducing new articles into law, explicitly stating obligation providers victims.
